The Federal Trade Commission recently finalized a $20 million settlement with Vivint Smart Home over alleged misuse of credit reports, marking one of the largest Fair Credit Reporting Act (FCRA) penalties to date. The FTC alleged, among other things, that the Company’s sales representatives improperly used credit reports of unrelated individuals with higher credit scores to qualify potential customers who would have otherwise been rejected for poor credit. The settlement underscores the significant financial and reputational risks of non-compliance with credit regulations, as well as the FTC’s increased focus on enforcing proper credit report usage. This enforcement action demonstrates that credit compliance must be a key component of dealers’ overall compliance strategy.
