On October 1, the Kentucky Division of Occupational Safety and Health (KOSH) adopted an emergency regulation that allows Kentucky businesses to designate a third party (including union representatives) to accompany inspectors in their walkaround inspections. The emergency clause requires the regulation to be effective immediately.
As a state plan, Kentucky had until October 1 to either adopt a regulation at least as strict as the OSHA walkaround standards or follow its federal counterpart. The day before this deadline, Kentucky OSHA adopted an emergency rule to ensure that it fulfilled its obligations.
What Does This Mean?
Similar to the federal standards, representatives accompanying KOSH inspectors will no longer have to be employees of the business. Additionally, these representatives do not necessarily have to be industrial hygienists or safety engineers.
